AGRICULTURAL LAND
The land is urbanistically framed as agricultural land in the territory of the Municipality of Massignano (AP, Ascoli Piceno, Marche, Italy). It enjoys a favorable south-west exposure, offering the possibility of a non-industrial agricultural use.
Its surface is 18220 square meters (as reported in the land register) of which:
- 13780 square meters are cultivated as an olive grove with 140 - 150 olive trees, some of which centenary. The trees are partially present in flat ground, others in terraced ground, and still others in sloping ground.
- 4310 square meters consisting of mixed forest
The cadastral parcels constituting the land are indicated by numbers 307, 308, 309, 117, 118, 119, 407 in the sheet 9 of cadastral map.
HABITATION
A)
The existing building in the land enjoys a fascinating view over the valley of the Menocchia stream which, unlike the adjacent valleys, has preserved its almost intact rural landscape and does not have large industrial areas impacting in the panorama. Of great value is the enchanting opening on the Sibillini Mountains which, framing the valley, in every season offer unique and evocative views.
The structure is a farmhouse built prior to 1894, of historical/cultural interest being already present in the Gregorian cadastre of 1815. Once on 2 floors, now the building is in a state of ruin as it has no roof and attic between the two levels.
The external measurements are 7.92 meters by 4.5 meters (gross area of about 35.5 square meters) with a height of about 6.5 meters at the top.
The building, positioned with a southeast-northwest axis along the long side, has a strategic layout since its north elevation, set against a high arenaceous wall, is protected from the elements. At same time the south elevation ensure a large amount of natural light as well a high irradiation of the surfaces. This favors a good winter warmth of the building and offers the possibility of exploiting solar energy as a renewable and low-cost source.
In support of the structure in the courtyard there are:
1) a masonry accessory, previously intended as stall for animals, with dimensions 2.45 meters by 3.98 meters and a height of 1.7 meters;
2) a cave carved into the sandstone wall, used in the past as a cellar with a surface area of considerable size and a height of about 3 meters, internally in bare rock. The cave is not registered in the land registry, but could offer the possibility of being used for the most varied destinations, obviously respecting the health and hygiene regulations in force;
3) and finally, nestled in the rocky part, there is an old brick wood oven still intact.
Also of great effect is the presence, in the vicinity of the house, of some centenary oak trees that enrich the surrounding environment with abundant shade, particularly enjoyable in the summer season.
According to current regulations, the building can be renovated without prior demolition, maintaining the shape of the building and the external appearance of the facades.
A possible extension is granted only if having characteristics such as to harmoniously coexist with the pre-existing complex (art.15 L.R.n.13 8 / March / 1990).
The extent of the enlargement will have to be assessed by the municipal building commission, however the legislation on the subject (Article 6 of Regional Law 13 8 / March 1990) indicates the possibility of a maximum extension of 20% which in this case would be approximately of 39.5 cubic meters, that is 7.3 square meters per floor considering a height of 2.70 m. This extension, presumably implemented by construction in adherence to one of the shorter sides of the building, would involve an extension of the long side of about 1.6 meters.
Alternatively, the extension could be made by raising as the current structure is likely to have a height above ground of less than the 7.5 m allowed.
B)
If the land were used for the construction of a farm, to the owner direct grower would be granted the possibility of:
1) renovate the existing building without prior demolition, exactly as indicated above
2) or build a new home commensurate with the housing needs of the owner direct cultivator, family members employed in the activity and their dependents, with a maximum volume limit of 1000 cubic meters, a maximum height above ground of 7.5 m, a minimum distance from the boundaries of 20 m, a detachment of 50 m from the existing building,
In this second case the existing building must be restored and destined, by means of a constraint to be transcribed in the registers of the real estate property by the municipality (at the expense of the interested party), to annex agricultural at the service of the farm.
The eventual new building must, according to the law, have architectural characteristics and make use of types of materials in harmony with the traditional settlements of the rural landscape.
The new building could be built in the less sloping part of the land, indicatively in the perimeter of parcel 118, near via San Pietro, upon request to the Municipality for a variant to the General Town Plan since this surface has been erroneously included among the restricted areas on the slope (that is, the inability to build due to a slope greater than 30%) although from the official cartography it is evident that in the medium-low part of the land, in particular in the parcel 118, the slopes of the ground are lower than the limit of 30%.
DIRECT GROWER
To acquire the status of direct farmer, it is necessary, first of all, to be the owner (or tenant) of a land that requires at least 104 working hours per year. In addition a full registration fee and an annual fee for agricultural contributions must be paid to the Direct Farmers' association.
ACCESS TO SERVICES
(electricity, sewerage, drinking water, methane gas)
1) The connection to the electricity supply is easily implemented as there is a power line suitable for the purpose right in the ground.
2) The public sewer line is not present in the immediate vicinity of the bottom, so an autonomous waste disposal system will be required.
3) The connection to the general aqueduct, to be done at the user's expense, will be possible as it is located along the Via S. Pietro road which skirts the 118 parcel of the land.
4) The methane gas line does not exist near the ground so, depending on the needs, it will be necessary to use an external container for LPG.
ROADS
A)
Currently, the access road to the land and the ruined farmhouse is represented by a local road that winds along the border between parcels 307 and 308 (not indicated in the cadastral map).
B)
In case of construction of a new building in the flatter part of the parcel 118 it would be useful and convenient to create a new access that connects the municipal road Via S. Pietro to the aforementioned parcel by stipulating an easement with the Municipality or with the owner of the neighboring parcel. 247.
C)
"Il Felletto" local road
A small road called “Il Felletto ", which has always existed and used in the past as a pedestrian way to reach the town of Massignano from the rural areas, winds its way east/west within the land and the neighboring ones. Since this road is no longer used for this purpose, it has been decommissioned and has remained as such the property of the Municipality, which invites the owners of the lands to voluntarily purchase the wreck of the road insistent on their property, at the price of the agricultural land.

The land is located in the immediate vicinity of the urban center of Massignano.
It is distant 6 km from the Massignano beach (Marina di Massignano, on the Adriatic Sea), and 60-90 km from mountains of medium height.
Some nearby seaside resorts (5-20 Km) are Cupramarittima, Grottammare, S. Benedetto del Tronto, Porto S. Giorgio, then a little further away (65-70 Km) Numana and Sirolo
Some characteristic nearby mountain areas, equipped with winter ski facilities, are: Monte Piselli (Teramo, 1400-1600 meters above sea level); Sassotetto (Sarnano, 1300-1600 meters above sea level); Monte Prata (Castel Sant'Angelo sul Nera, 1500-1800 meters above sea level).
Important surrounding towns, rich in history, art and culture, distant 30-100 km from Massignano are Fermo, Ascoli Piceno, Ancona, Loreto, Macerata, Recanati and Camerino. Loreto is particularly important in the religious field because it houses a very famous Catholic Sanctuary dedicated to the Madonna, Mary mother of Jesus. Macerata, Ancona and Camerino are also home to important and ancient universities. The first provides studies in the humanistic-legal field, the other two mainly in the scientific field (physics, chemistry, medicine, engineering, economics and commerce).
